Abusive and Deadly Uses of Seclusion and Restraint

July 31, 2009 Arne Duncan, U.S. Secretary of Education, wrote to the chief officers of education for each US state expressing concern about the testimony heard recently by the Education and Labor Committee of the U.S. House of Representatives, and recommending that states adopt "Positive Behavioral Interventions and Support."


The U.S. House of Representatives’ Committee on Education and Labor held a hearing on May 19, 2009, to discuss the abusive and deadly use of seclusion and restraint by teachers and school staff. The hearing shed light on the information recently released in the United States Government Accountability Office (GAO) Report on Seclusions and Restraints: Selected Cases of Death and Abuse at Public and Private Schools and Treatment Centers. The most extreme cases include: young children being tied down, having their mouths taped shut, being locked in small spaces for extended periods of time, and being crushed by a teacher as a way to prevent disruptive behavior. The GAO reported that in one academic year in California and Texas, 33,000 cases of abuse and restraint were reported, 20 of these resulting in death.  The issue of seclusion and restraint in schools is widespread across the nation, yet unknown to many parents. It is critical for parents of children with learning disabilities to be aware of this alarming practice, because the cases that are most often seen involve children with disabilities.

Chairman George Miller (D-CA) and the Committee heard testimony from Toni Price, who spoke about how a teacher’s abusive behavior led to the tragic death of her foster son, Cedric. Cedric was suffocated when his teacher sat on him in order to stop him from getting out of his seat. Mrs. Price explained how there were few repercussions for the teacher, who continues to teach in another school district.  As reported by the GAO, as well as the National Disability Rights Network (NDRN) and the Council of Parents Attorneys and Advocates (COPAA), these stories are all too common in the nation’s school systems today.

Federal Laws and Disciplinary Issues


There are currently no federal laws that specifically prohibit the practice of seclusion and restraint in schools. A few states have laws addressing this practice, but rarely are the accompanying regulations and guidelines being followed. One federal law, the Individuals with Disabilities Education Act (IDEA), does provide some guidelines regarding serious behavior or disciplinary issues for students with disabilities. The IDEA mandates that special education students all have an Individualized Education Program (IEP), developed by parents and school personnel. Parents should make sure that their child’s IEP includes specific instructions related to the use of strategies and interventions if behavior and/or disciplinary issues arise. It’s important to know that although the IDEA requires that eligible students be educated in the least restrictive environment (LRE), the concept of LRE doesn’t specifically exclude the practice of seclusion or restraint.

One of the main problems is that the “appropriate” uses of seclusion and restraint are not defined by any of the federal regulations or guidelines that are currently in place. Some researchers and education professionals believe that mild forms of seclusion and restraint are necessary in what they call “emergency situations.” These are situations when a child is endangering himself, students, or staff. More research is needed so that informed legislation can be created to protect students by either banning all, or select forms of seclusions and restraint.

At this time there are no federal laws to guide states in the investigation and prosecution of abuse of students, including students with disabilities. Only 31 states have either their own official policy or suggested guidelines for the use of restraint, and only 24 states have their own official policy or suggested guidelines for the use of seclusion. Many policies and guidelines designate the responsibility to individual school districts. Parents have few options when these problems arise: School administrators and teachers are reportedly not held accountable, Child Protective Services (CPS) do not have the jurisdiction, and the police, who are willing to help, do not have the resources or expertise to fully investigate these cases.

State Reforms’ Potential Impact on Federal Legislation


Some states are implementing reforms that are showing promising results. The state of Illinois has implemented a program called “Positive Behavior Interventions and Support (PBIS).”  PBIS is a proactive systems approach to establishing the behavioral supports and social culture that are needed for all students in a school to achieve social, emotional, and academic success. This system has been implemented in 1,000 Illinois schools and data has shown a significant reduction in suspension and expulsion rates, as well as improved academic achievements across the board.

Vermont has also established a statewide PBIS initiative and currently 59% of the state’s public schools are included in this program. Over 18,000 students in Vermont have benefitted from PBIS. The Vermont Department of Education’s Annual Report for 2009 accounted that the office discipline referrals decreased from 64% to 28% in schools that have fully implemented the program. Although PBIS has been proven effective in states which have taken on the challenge of reforming their schools, it has not been universally embraced by all states and school districts.

In response to the GAO report and the House hearing, key education and disability organizations – including the National Center for Learning Disabilities – are meeting with Hill leadership to discuss possible policy solutions. Ideas range from the implementation of national reforms (e.g., PBIS), to the creation of a national registry of teachers who have records of using inappropriate seclusion and restraint, which could be accessed by all states before offering employment.

NCLD is monitoring federal activities related to this issue and providing information to Congress in hopes of promoting legislation to improve early intervention and preventing abuse of children in our nation’s schools.
